Terms and Conditions

In order to avoid any misunderstanding in respect of your booking, the following Terms of Business apply to all bookings. Your cooperation and understanding of our terms & conditions is greatly appreciated and we have tried to make our Terms of Business as straight forward as possible. If however you have any questions please feel free to speak to us.

1. Booking Confirmation  

  1. The Registration process must be completed and the payment (or first payment if it is instalments or multiple payments) received prior to the commencement of the service provided by Subhan Nair or The Hatha Yoga Effect.

  2. The fees are payable by the appropriate methods outlined by The Hatha Yoga Effect. This fee must be received prior to services being delivered. 

  3. Any monthly instalments are payable by Standing Order or other form of Automated Bank Transfer, to be initiated on the agreed commencement date, and then the agreed date of the following months, in advance of services being provided by Subhan Nair or The Hatha Yoga Effect. Should payment not be received, service will cease on the last day of the month and this agreement will be deemed subject to clause 1.8 below. 

  4. Any late payment of the monthly fee to Subhan Nair or The Hatha Yoga Effect will be subject to an administration fee, payable immediately along with the late payment. A late payment is one that does not arrive in the bank account by the last day of the month. 

  5. Availability on The Hatha Yoga Effect's programmes are limited, and therefore The Hatha Yoga Effect reserves the right to refuse service to anyone without offering a reason.

  6. Alternative arrangements can only be made for the payment of the candidate's fee at the discretion of Subhan Nair.

  7. The Hatha Yoga Effect reserves the right to terminate their provided service if: 

    • the Client is in breach of these terms & conditions 

    • the Client's conduct is deemed to be unprofessional, inappropriate or disruptive 

    • the Client's conduct impacts on The Hatha Yoga Effect or Subhan Nair's reputation in a negative way 

    • the Client's conduct impacts on another client in a negative way 

  8. Termination of an agrees term by The Hatha Yoga Effect is subject to the entire fee, all refunds are subject to Subhan Nair's discretion. Upon termination an invoice will be created for any remainder of the fee outstanding to be settled within thirty days.

  9. A booking is confirmed upon payment and registration is received from you. The payment is should be in full unless you have agreed a series of instalments have been agreed or deposit. Receipt of the signed terms will be deemed to be your acceptance of these terms.

2. Deposits

The Hatha Yoga Effect reserve the right to request payment of any deposit at any time prior to the commencement of the event, the amount to be determined by us. Failure to pay the requested deposit within 3 days of being asked to do so will result in the release of the booking. Deposits are non-refundable but can be transferred at our discretion. 

3. Payment and Credit Facilities

Payment shall be made by cash, bank transfer or credit/debit card (we do not accept American Express). Where credit facilities have been agreed all final accounts are payable within 30 days of invoice unless otherwise contracted and agreed with The Hatha Yoga Effect. We reserve the right to charge interest on all invoices outstanding past the due date. All accounts on which a query is not raised within 7 days of presentation shall be deemed to have been approved as presented. 

4. Cancellation Policy

If you have booked a place and are unable to attend a workshop for any reason, please let us know as soon as possible so that your place may be offered to someone else. 

Classes

If you need to cancel a pre-registered booking for a class, please let us know prior to 72 hours before the class for a full refund (a 5% admin fee will be deducted). Unfortunately refunds cannot be issued for cancellations made less than 72 hours prior to the class as well as non-attendance on the day or any days within the  course, are. In certain circumstances, you may be able to transfer the payment to an alternative future class.

Workshops

If you have booked a place and are unable to attend a workshop for any reason, please let us know as soon as possible so that your place may be offered to someone else. 

If you are pre-registered for a workshop you must cancel at least 10 days prior to the workshop to receive a full refund (excluding any online booking fees) but a 5% admin fee will be deducted from the cost of the workshop. Cancellations made from 10 days to 48 hours prior to workshop will be liable for a 25% cancellation fee or minimum £25 fee for smaller courses. Refunds cannot be issued for cancellations made less than 48 hours prior to the workshop as well as non-attendance on the day or any days within the  course, are. In certain circumstances, you may be able to transfer the payment to an alternative future workshop or course but this be down to the discretion of the The Hatha Yoga Effect and is subject to £15 fee. 

Retreats

If you need to cancel your retreat booking the following fees will apply; 

Between 8 to 4 weeks before the event is scheduled to take place - 50% of the total booking value paid

Between 4 to 2 weeks before the event is scheduled to take place - 80% of the total booking value paid

Between 14 to 8 days before the event is scheduled to take place - 90% of the total booking value paid

7 days or less there will be no refund will be issued

The percentage of booking value is based on the rate charged to the delegate. 

6. Cancellation by us

In the unlikely event that The Hatha Yoga Effect has to cancel your booking, you will receive back any pre payment; The Hatha Yoga Effect will not have any other liability. However The Hatha Yoga Effect may only cancel if; 

a. If an event is moved from its advertised venue and/or the date is changed. In this case your payment will remain valid if you wish to attend the rescheduled event. If not, we will issue a full refund. 

b. If either party become insolvent, or in case of an individual, become subject to bankruptcy petition. 

c. The booking, the persons associated with the booking and/ or the purpose of the event might damage the reputation of the company.
